What is the Shops & Establishment Act?
The Shops and Establishments Act regulates working conditions, opening/closing hours, holidays, leave, payment of wages, conditions for women workers, etc. It applies to all commercial establishments (shops, offices, restaurants, theatres, hotels).
It's a STATE legislation — each state has its own Act (e.g., Maharashtra Shops & Establishments Act, 1948 / 2017; Delhi Shops & Establishments Act, 1954). Compliance requirements vary slightly by state.
Who needs to register
Any commercial establishment, regardless of size:
- Retail shops (kirana, electronics, clothing, etc.)
- Offices (corporate, professional services, consultancies)

Manufacturing factories are covered separately under Factories Act, not S&E.
Key provisions of typical S&E Act
- Working hours: Max 9 hours/day, 48 hours/week (overtime allowed with pay)
- Spread-over: Total spread (work + break) max 12 hours
- Rest interval: Half-hour after 5 hours of continuous work
- Weekly off: One day rest per week (typically Sunday)
- Holidays: National + festival holidays per state's list
- Leave: Earned/casual/sick leave per state rules
- Wages: By 7th or 10th of next month (per Payment of Wages Act)
- Women workers: Restrictions on night work (some states); separate provisions for safety
- Children: Cannot employ children below 14 (Child Labour Act applicable)
Registration process
Process varies by state but generally:
- Visit State's labour department portal or specific S&E portal
- Fill registration form with:
- Establishment name and address
- Owner/employer details
- Type of business
- Number of employees (separately for males, females)
- Type of working (day, night, both)
- Upload supporting documents:
- PAN of establishment
- Aadhaar of employer
- Address proof (rent agreement / utility bill)
- Photo of establishment
- Pay registration fee (varies, typically ₹500-2,500 based on employee count)
- Submit; certificate generated within 7-15 working days
- Display certificate prominently at workplace
Renewal and compliance
- Renewal: Annually or every 3-5 years depending on state. Renewal fee similar to registration.
- Update info: Notify changes in employee count, address within 15-30 days
- Records: Maintain registers of employees, wages, overtime, leave, advances
- Display: Notice board with daily/weekly working hours, weekly off, holidays
- Inspection: Labour Inspector may visit; cooperate and produce records
Frequently Asked Questions
Single owner with no employees — registration needed?
Yes, in most states. Even one-person consultancies/freelancers operating from a registered office should register. Some states give partial exemption to truly small establishments — check state rules.
Online businesses (e-commerce, SaaS) — covered?
Yes, if there's a physical office (even home office). Registration is for the establishment (office). The 'shop' definition is broad and covers all commercial activities, not just retail.
What about coworking space — who registers?
Generally each TENANT in the coworking space registers their own business at the coworking address. Coworking provider also registers separately for their own operations. Verify with state-specific rules.
Penalty for non-registration?
Varies by state but typically ₹500-5,000 per day of operation without registration, plus court complaint. Most states are lenient on first-time defaults; chronic non-compliance can lead to closure orders.
