What is ESIC and its purpose?

The Employees' State Insurance Corporation (ESIC) provides medical and cash benefits to insured workers and their dependents. Governed by the Employees' State Insurance Act, 1948. Benefits include:

  • Medical treatment (cashless at ESIC hospitals/dispensaries)
  • Sickness benefit (cash for medical leave)
  • Maternity benefit (women workers)
  • Disability benefit
  • Dependent's benefit (in case of work-related death)
  • Funeral expenses
  • Unemployment allowance under Rajiv Gandhi Shramik Kalyan Yojana

Applicability — Establishment and employee criteria

Establishment:

  • 10+ employees in non-seasonal establishments (most states)
  • 20+ in some categories

Employee wage threshold:

  • Wages up to ₹21,000/month — Mandatory ESIC coverage
  • Above ₹21,000/month — Not covered (separate health insurance)
  • Disabled employees: Up to ₹25,000/month covered

'Wages' here = Basic + DA + HRA + Other allowances (excluding bonus, overtime, conveyance for distance > 8 km).

Contribution rates (FY 2025-26)

Effective from 1 July 2019 (reduced rates):

  • Employee contribution: 0.75% of wages
  • Employer contribution: 3.25% of wages
  • Total: 4% of wages

Example: Employee with ₹15,000 monthly wages:

  • Employee's share: ₹112.50 (deducted from salary)
  • Employer's share: ₹487.50 (paid by employer over and above salary)
  • Total ESIC contribution: ₹600/month

Registration process

  1. Visit esic.in → Sign Up as Employer
  2. Create User ID with PAN, email, mobile
  3. Fill establishment registration form (Form 01):
    • Establishment details (name, address, type)
    • Owner/employer details
    • Bank account details
    • List of employees (Name, Aadhaar, Date of Joining, wages)
  4. Upload supporting documents:
    • PAN of establishment
    • Aadhaar of authorised signatory
    • Bank statement
    • Address proof of establishment
  5. Submit — ESIC code (17-digit registration number) generated
  6. Within 7 days, ESIC officer may visit for inspection
  7. Generate IPs (Insured Person numbers) for each employee

Monthly compliance — ECR filing

Like EPF, ESIC requires monthly Electronic Challan-cum-Return (ECR):

  • Due date: 15th of next month
  • Login to esic.in → Employer login
  • Generate challan with employee-wise contributions
  • Pay total amount through net banking
  • Download payment confirmation

Penalty for late deposit:

  • 5% per annum on the amount delayed (first day to 60 days)
  • 10% per annum (61-180 days)
  • 15% per annum (above 180 days)
  • Plus damages 5-25% under Section 85B

Frequently Asked Questions

If wages cross ₹21,000 mid-year, does ESIC continue?
Yes. If an employee was an Insured Person at any point in a contribution period (April-September or October-March), they continue to be covered for that ENTIRE contribution period even if wages cross ₹21,000. Only the next contribution period sees the change.
Employee not interested in ESIC — can they opt out?
No. ESIC is statutory; not optional. If employee wages are within threshold AND establishment is covered, ESIC contribution must be deducted. Employee cannot opt out.
Different states have different rules?
Mostly uniform under central ESI Act. But contribution areas (geographic coverage) vary by state. Establishment must check if their specific area is notified as a 'covered area'. Most metros and tier-1/2 cities are covered.
Is ESIC applicable to one-person establishments?
No. ESIC requires 10+ employees. For solo businesses, no ESIC. The proprietor is not a 'worker' under the Act.
